Please read these terms and conditions carefully. They set out the agreement between you and us with respect to your purchase. By placing a furniture order with NC Furniture Unlimited, you are agreeing to all of these terms.
Order Placement and Acceptance
By placing a furniture order with NC Furniture Unlimited, you agreeing to all "Terms Of Sale" and are making an irrevocable offer to purchase the goods specified at the price listed in the order. Please be sure your order is correct before you submit it. Due to the steep discounts we offer and the high volume of our business, we cannot honor requests for order changes, cancellations or refunds once you have placed your order unless the item(s) have been discontinued or acknowledged to be on backorder. In the event of discontinued or backordered items, we will offer you the ability to reselect a different item, set or group of equal value. You may also upgrade to a more expensive item, set or group and pay the difference, or request a full refund.
All orders are subject to acceptance or rejection by us. Our electronic or telephone acknowledgement of your order is only to confirm that your order has been received, but does not constitute acceptance until we have verified price and availability with the manufacturer. Your order is accepted by us only when we provide you with notice that your payment has been processed and a projected delivery time is confirmed. The order process usually takes 30 to 80 business days to arrive to our warehouse after acknowledgement by the manufacturer. We will notify you as soon as possible if any part of your order is delayed or has been discontinued by the manufacturer, but this will not delay the processing of the remainder of your order. Please remember, we are not responsible for delays by the manufacturers.
Payment
We accept payment by Credit Card, Debit Card, Personal Check, Cashiers Check, Money Order, and Wire Transfer. We do not accept any other forms of payment, and do not offer C.O.D. terms.
Shipping Charges and Taxes
Shipping charges (if any) provided at the time of order are estimates only, and are subject to confirmation by the independent carrier that will deliver your order. All items delivered to locations in North Carolina are subject to sales tax (currently 7.75%). We may collect sales taxes for delivery in other states if required to do so under applicable law. If your state assesses any use tax for items purchased and delivered from outside the state, you are responsible for reporting and paying such taxes.
Threshold Delivery
Sometimes we offer a Threshold Delivery option when placing your order.
NC Furniture Unlimited makes this offer to save you more money. Once your order arrives to our warehouse all items will be inspected to pass our quality control and released to one of our delivery companies for routing on the next truck to your area. East Coast deliveries usually take 2-4 weeks, West Coast and Rural area deliveries usually take 4-6 weeks. The delivery company will call you in advance to schedule a date and time for you to be available to accept delivery. Threshold Delivery consist of uncrating or unboxing your furniture and bringing your furniture pieces into the threshold of your home. The delivery company will Not move previous furniture pieces or clear a room or area where furniture is to be placed. Threshold delivery does not include any setup or assembly. The delivery company will NOT take the furniture to a designated room. Delivery personnel are not allowed to accept or dispose of shipping cartons, crates or packing materials, so disposal of these items is your responsibility. We do offer and recommend "White Glove" Delivery.
White Glove Delivery
We recommend White Glove Delivery. If you need assembly and setup of your furniture, we offer White Glove Delivery for an extra fee. Furniture can be very heavy and some pieces will require assembly. The delivery companies we use specialize in handling, placing and assembling furniture. Once your order arrives to our warehouse all items will be inspected to pass our quality control and released to one of our delivery companies for routing on the next truck to your area. East Coast deliveries usually take 2-4 weeks, West Coast and Rural area deliveries usually take 4-6 weeks. The delivery company will call you in advance to schedule a date and time for you to be available to accept delivery. The delivery company will uncrate or unbox your furniture pieces, bring the furniture pieces into the room you designate and perform light assembly and setup. They will not hang mirrors, pictures, or any wall decor. The room you designate the furniture to be placed must be easily accessible. Delivery personnel are not allowed to accept or dispose of shipping cartons, crates or packing materials, so disposal of these items is your responsibility. The delivery company will Not move previous furniture pieces or clear a room or area where furniture is to be placed.
Delivery Schedules And Set-Up
We order your furniture directly from the manufacturer, and ship it by an independent carrier. We will estimate the likely delivery time for you based on the best information we have from the manufacturer and shipper. Please remember that these are only estimates. They are subject to many factors outside our control, and therefore cannot be guaranteed. Remember that furniture can be bulky. Neither we nor the carrier will be responsible for costs or delays due to insufficient clearance for items to be delivered. Dimensions of all furniture are available on our website and it is your responsibility to measure all stairwells, hallways, doorways and elevators to be sure there is adequate clearance for your furniture order. NC Furniture Unlimited will not be responsible for any of your furniture not fitting in your home. When the carrier calls to schedule delivery, advise them of these dimensions and of any other conditions of your home and property that might be an issue, such as steep or winding driveways, long flights of steps or icy or snowy conditions. Remote or inaccessible locations may cause a delivery surcharge, or may require that you accept delivery at an alternate location that is accessible.
Delivery personnel are not allowed to accept or dispose of shipping cartons, crates or packing materials, so disposal of these items is your responsibility.
Delivery Acceptance and Inspection
You must inspect your order upon arrival and notify the carrier of any damage incurred during shipping, as well as of any defects in manufacturing that can be observed upon reasonable inspection. Note any problems in writing on the bill of lading before the driver leaves. UNLESS AN ISSUE IS NOTED IN THIS WAY, YOU WILL BE DEEMED TO HAVE ACCEPTED THE GOODS IN THE CONDITION DELIVERED. If you cannot be there to accept the delivery in person, please arrange for another responsible adult to be present who can act on your behalf.
All goods are professionally packed by the manufacturer for shipping, but damage during shipment can sometimes still occur. Shipping damage is the responsibility of the carrier, and any manufacturing defects are the responsibility of the manufacturer. Neither is a likely occurrence, but we will assist you in resolving such issues in any way we can, so long as they are recorded by you at the time of delivery as described above. In many cases, damage or defects can be corrected on site, eliminating the need to re-pack and return the goods. If not, the carrier will be responsible for returning the item, and it will either be repaired or replaced and will be redelivered at no additional expense to you.
Pickup Option
If you prefer, you may arrange to pick up your order from our store warehouse in North Carolina. Please advise us that you wish to do this at the time of order, and we will notify you when the order is ready so that you can schedule a pickup time. Our warehouse staff will bring your furniture to the dock. It is your responsibility to load, strap and protect your furniture. Please be sure your vehicle is of sufficient size to accommodate the goods, bring tie straps and help for loading. Furniture is very heavy! NC Furniture Unlimited will NOT be liable for any injuries incured to you or anyone helping you load your furniture. NC Furniture Unlimited offers White Glove Delivery for many of these reasons. If you decide to pick up and deliver your furniture, NC Furniture Unlimited WILL NOT be liable for any furniture damage once you leave our warehouse. You accept ALL Liability. North Carolina sales tax of 7.75% must be collected on all orders picked up in North Carolina.
Warranty And Warranty Disclaimer
All goods are warranted by their respective manufacturers, and we pass these manufacturer warranties on to you. A copy of the written manufacturer warranty will be included with your order if it is the manufacturer’s policy to do so, and may be obtained from us at any time upon request.
NC FURNITURE UNLIMITED, MAKES NO WARRANTIES OF ANY KIND WITH RESPECT TO THE GOODS IT SELLS. ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE ARE HEREBY DISCLAIMED.
SOME STATES OR OTHER JURISDICTIONS DO NOT ALLOW THE DISCLAIMER OF IMPLIED WARRANTIES, SO THE ABOVE DISCLAIMER MAY NOT APPLY TO YOU. YOU MAY ALSO HAVE OTHER RIGHTS THAT VARY FROM STATE TO STATE AND JURISDICTION TO JURISDICTION.
Limitation of Liability
IN NO EVENT WILL NC FURNITURE UNLIMITED, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR ANY OTHER PECUNIARY LOSS. THIS LIMITATION APPLIES NOTWITHSTANDING ANY FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY AND TO THE FULLEST EXTENT PERMITTED BY LAW.
SOME STATES OR OTHER JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS AND EXCLUSIONS MAY NOT APPLY TO YOU.
Governing Law
This agreement is governed by and construed in accordance with the law of the State of North Carolina, applied without regard to its conflict of laws provisions.
